Terms of Service

Agreement

These Terms of Service govern your access to and use of Clinic Pixel Audit, a product of Eschaton Labs LLC ("we," "us"). By using the website, running a scan, completing a purchase, creating a monitoring subscription, or otherwise using the service, you agree to these Terms on behalf of yourself and any organization you represent.

Service

Clinic Pixel Audit is a technical scanning and monitoring tool for public websites. The service crawls public webpages, detects tracking pixels, analytics tags, marketing scripts, and related signals, and generates reports intended to help website owners, developers, agencies, and privacy reviewers identify and prioritize potential tracking-risk issues.

Reports are based on public-page evidence available at scan time. The service may not detect every page, script, tag, trigger, consent state, browser behavior, or legal consideration.

No Legal, Medical, Or Compliance Certification

Clinic Pixel Audit provides technical evidence and operational guidance only. It is not legal advice, medical advice, a security audit, a HIPAA compliance certification, or a substitute for review by qualified legal, privacy, compliance, security, or technical professionals.

Authorized Use

You may use Clinic Pixel Audit only to scan websites you own, operate, manage for a client, or are otherwise authorized to assess. You may not use the service to scan private systems, internal networks, patient portals, password-protected areas, or systems you do not have permission to test.

You agree not to misuse the service, interfere with its operation, attempt to bypass rate limits or access controls, reverse engineer the service, submit malicious content, or use the service for unlawful, harmful, or deceptive purposes.

Submitting a domain is your representation that you are authorized to have it scanned. You will defend and indemnify us against third-party claims arising from scans of domains you submitted without sufficient authorization.

Reports And White-Label Use

Your reports are yours to use for your organization's internal compliance purposes and to share with your advisors, vendors, and counsel. Agency Reporting subscribers may additionally deliver white-labeled reports to the clients whose domains they monitor under their plan. Reports may not otherwise be resold or redistributed. Audit report links remain valid for a limited period (currently 90 days) — download the PDF and CSV for your records. We retain all rights in the service and software.

Healthcare And Sensitive Information

Clinic Pixel Audit is designed for public website evidence and does not require patient records, portal access, or protected health information. Do not submit patient records, account credentials, medical information, or other sensitive personal information to the service. Unless we separately sign a written business associate agreement, Clinic Pixel Audit is not acting as your HIPAA business associate.

Subscriptions, Billing, And Cancellation

Paid monitoring plans are billed through Stripe in advance on a recurring basis (monthly, or annually where offered) and renew automatically until canceled. The one-time Pixel Audit may include additional domains at the listed per-domain price; Agency Reporting includes the listed number of client domains, with additional domains billed at the listed per-domain monthly price on the same subscription. By starting a paid plan, you authorize recurring charges for the selected plan and any applicable taxes, and you are responsible for keeping billing information current. Subscription price changes take effect at your next renewal after reasonable notice.

You may cancel a subscription at any time from the billing portal linked in your monitoring dashboard. Cancellation stops future renewals, and paid access continues until the end of the current billing period. The one-time Pixel Audit includes a 7-day guarantee: if the audit is not useful to your team, request a refund within 7 days of report delivery (for example, by replying to your report email) and we will refund the audit fee in full. Other fees are generally non-refundable, and partial periods are not prorated, except where required by law or expressly agreed in writing.

Accounts And Access

You are responsible for maintaining the confidentiality of any account, admin, billing, or access credentials associated with your use of Clinic Pixel Audit. You are responsible for activity performed through your account or credentials.

Availability And Changes

We aim to keep the service useful and reliable, but we do not guarantee uninterrupted availability. We may modify, suspend, or discontinue parts of the service, change plan features, or update these Terms from time to time. If a material change affects active paid customers, we will take reasonable steps to provide notice.

Third-Party Services

The service may rely on third-party providers for hosting, storage, email delivery, payment processing, analytics, security, and other operations. Your use of payment processing is also subject to Stripe's applicable terms and policies.

Disclaimers

Clinic Pixel Audit is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.

Limitation Of Liability

To the fullest extent permitted by law, Clinic Pixel Audit will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; for lost profits, lost revenue, lost data, or business interruption; or for regulatory fines, penalties, compliance outcomes, or third-party claims arising from the condition of your (or your clients') websites. Our total liability for claims related to the service will not exceed the amounts you paid to us for the service in the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules. Courts located in Madison County, Alabama have exclusive jurisdiction over disputes arising from the service, and each party consents to personal jurisdiction there.
